Terms of Acknowledgement – Embark Gifting
You are responsible for and must keep track of your Contribution Limit. This applies whether or not you made the contribution yourself or received contributions through Embark Gifting. If a contribution through Embark Gifting causes you to exceed the Contribution Limit of your RESP, you are responsible to contact Embark Student Corp. (“Embark”) to advise us and request a reversal of the contribution(s). If you incur any tax on any excess contribution in your RESP, you agree that you are responsible to pay all or any part of the total taxes levied regardless of when such tax is levied. Embark is not responsible for keeping track of your Contribution Limit nor is Embark responsible for any taxes, fees, charges or levies incurred by you or on your RESP as a result of any over-contributions in excess of the Contribution Limit.
You will be responsible to keep track of the contributions to your RESP and your Contribution Limit. Under no circumstances is Embark liable to you for any of the following: (i) any excess contributions in excess of your Contribution Limit; (i) delays in Embark Gifting, reflecting gifted contributions to your RESP; (ii) failure to notify or advise us of contributions in excess of your Contribution Limit; or (iii) for any actions taken or not taken by you in respect of monitoring or managing your Contribution Limit.
Embark Gifting – Terms and Conditions for the Gifter
The gift amount, net of processing fees, will be applied as a contribution to the Beneficiary’s Registered
Education Savings Plan (RESP). This gift is not refundable and once the funds are transferred into the RESP, the gifter relinquishes all claims or rights to the contributed amount. In accordance with the Income Tax Act (Canada), contributions made to the RESP may be either paid to the beneficiary or returned to the subscriber.
The gifter understands and agrees that the gift is not eligible for a charitable donation tax receipt or any other form of tax credit or deduction.
1. Information Sharing – Purpose: When you make a gift through Embark Gifting, certain personal information you provide (such as your name, email address, and any optional message accompanying the gift) may be shared with the recipient of the gift for the purpose of acknowledgment, gratitude, or other communication related to the gift.
1.2. Information Included: The personal information shared with the recipient may include, but is not limited to:
- Your full name.
- Your email address or other contact information (if applicable).
- Any personalized message you choose to include.
1.3. No Sensitive Information Disclosure: Payment details (e.g., credit card or banking information) are not shared with recipients. Embark Gifting will only provide information relevant to identifying the donor and facilitating communication.
2. Consent to Information Sharing: By completing a gift transaction through Embark Gifting, you explicitly consent to the sharing of the above-mentioned personal information with the recipient.
3. Responsibility for Shared Information: Embark Gifting is not responsible for how the recipient uses the shared information. The recipient is expected to use your information solely for purposes related to acknowledging your gift.
